These website terms of use (together with the documents, information and policies referred to in these terms of use) ('Terms of Use') set out the legal terms that apply to your use of ibdmate.com ('Website').

Please read these Terms of Use carefully and make sure that you understand them before using the Website as they are a binding agreement between you and Motilent Limited ('we', 'us' or 'our'), the parent company of IBD Relief Ltd, who own and operate the Website. By using the Website, you agree to be bound by these Terms of Use. If you do not accept these Terms of Use, you should leave the website immediately. If you use the Website, we will take this as your acceptance of these Terms of Use. For the avoidance of doubt, these Terms of Use are binding on you if you have been directed or granted access to this Website via a healthcare professional.

These Terms of Use refers to our Privacy Policy, which also applies to your use of the Website.

Access to the Website

This Website is made available free of charge and you are responsible for making all arrangements necessary for you to have access to the Website.

If you are a healthcare professional, we will provide you with a sign-up link to access the Website which will grant you access to a [healthcare professional dashboard]. You can then generate patient access codes to enable your patients to access selected [e-learning courses and other content].

Where you have been directed to the Website by a healthcare professional, we will generate a code for the healthcare professional to supply to you. You may then input the code into the Website to gain access to our e-learning courses and other content.

Website availability

We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. Access to the Website is permitted on a temporary basis and it does not include any commercial use of the Website or its contents. You must not reproduce, copy and/or exploit the Website for any commercial purposes without our prior written consent. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

The Website is directed to people residing in the United Kingdom. We do not represent that content available on or through the Website is appropriate or available in other locations. We may limit the availability of the Website or any service or product described on the Website to any person or geographic area at any time. If you choose to access the Website from outside the United Kingdom, you do so at your own risk and are responsible for compliance with local laws where they apply.

Your account and password

If you choose, or you are provided with, a user identification code (including any code given to you by a healthcare professional), password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@ibdmate.com.

Your conduct and acceptable use

You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.

You understand that you are responsible for all electronic communications and content sent from your device to us and you must use the Website for lawful purposes only.

You must not use the Website for any of the following:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm minors in any way;
  • to cause harm, annoyance, inconvenience or needless anxiety to any person;
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
  • to send, use or reuse any material that is: (i) illegal, offensive, abusive, indecent, defamatory, obscene or menacing; (ii) in breach of copyright, trade mark, confidence, privacy or any other right; (iii) otherwise injurious to third parties; (iv) objectionable; and/or (v) which consists of or contains software viruses; or
  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

Breaching these provisions may constitute a criminal offence under the Computer Misuse Act1990. We, in compliance with any enforceable law or public order, may report any such breach to the relevant law enforcement authorities and disclose your identity to them. If you breach any of the Terms of Use, you will indemnify us in full against all costs, expenses, liabilities, damages and losses (excluding any indirect, incidental or consequential loss), including any interest, fines and legal or other professional fees and expenses awarded against or incurred or paid by us and/or any member of our group as a result of or in connection with your breach.

Uploading content to the Website

Whenever you make use of a feature that allows you to upload content to the Website, or to make contact with other users of the Website, you must comply with the content standards set out in these Terms of Use. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the Website.

We have the right to remove any posting you make on the Website if, in our opinion, your post does not comply with the content standards set out in these Terms of Use.

The views expressed by other users on the Website do not represent our views or values.

Linking to the Website

You may link to the home page of our Website but you must do so in a way that is fair and legal and does not damage our reputation or take advantage of it (such as by using a link to suggest any form of association, approval or endorsement by us where none exists).

If you are a patient, please note that the content on the Website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Website.

If you are a healthcare professional, please note that the content on the Website is provided for general information only. It is not intended to amount to medical advice on which you should rely and you should not represent it as such to any of your patients. You must exercise your professional judgement and act with appropriate due diligence and care when using the Website.

We may update or change the Website or its contents at any time but we are under no obligation to do so. Although we make reasonable efforts to update the information on the Website, we make no representations, warranties or guarantees, whether express or implied, that the content on the Website is accurate, complete, up-to-date or free from errors or omissions.

Our liability in relation to the Website

To the fullest extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website, or any content on it, whether express or implied.

We are the owner or the licensee of all intellectual property rights in the Website and its content. The rights in the Website and the content are protected by copyright laws and treaties around the world. All such rights are reserved.
